Terms of Use
Last updated: October 25, 2026
These Terms of Use ("Terms") are a binding agreement between you and Hermar Group LLC ("Hermar Group", "we", "us" or "our") and govern your use of the PartyMaster mobile application, its content, subscriptions and related services, including this website (together, the "App"). By downloading, installing, accessing or using the App you confirm that you have read, understood and accept these Terms. If you do not agree, do not use the App.
1. The short version
PartyMaster does not encourage drinking alcohol.
PartyMaster is a party game for entertainment. Words like "sip", "drink" and "shot" are game mechanics, not instructions to consume alcohol. We strongly recommend that every shot or sip be water or another non-alcoholic drink. Any decision to drink alcohol is yours alone, must be legal where you are, and is entirely at your own risk.
- You must be at least 18 years old (or the age of majority where you live, if higher) to use the App.
- Participation in every game, challenge, dare, penalty and question is voluntary. Anyone can skip or stop at any time.
- Never drink and drive, never pressure anyone, and never do anything illegal, dangerous or non-consensual because the App suggested it.
- You use the App at your own risk. To the fullest extent permitted by law, we are not responsible for what you or other people choose to do while playing.
- Subscriptions renew automatically until you cancel them in your App Store or Google Play account settings.
This summary is for convenience only. The full Terms below control.
2. Eligibility and age requirements
The App is intended exclusively for adults. You may use the App only if you are at least 18 years old, or the age of legal majority in your jurisdiction if that is higher, and you are legally able to enter into these Terms.
Any game option that refers to alcohol (including drinking-themed modes, bonuses or penalties) may only be enabled by, and played with, people who have reached the legal drinking age where they are located (for example, 21 in the United States and 18 in most of Latin America and Spain). Before enabling such an option, the host must confirm that every participant meets this requirement, takes part voluntarily and has safe transportation arranged. Minors must never be served alcohol or take part in a drinking-themed game in any way.
If you allow other people to play on your device, you are responsible for making sure they meet these requirements and are aware of these Terms.
3. Alcohol policy: we recommend water for every shot
Use water. Seriously.
PartyMaster does not require, promote, encourage or reward the consumption of alcohol. The App works exactly the same with water, juice, soda or no drink at all, and water is the beverage we recommend for every shot, sip or drinking-related penalty.
You acknowledge and agree that:
- The words "shot", "sip", "drink", "toast", "cheers" and similar terms in the App describe game actions only. They do not define what is in the glass, and they are not a recommendation, instruction or invitation to consume alcohol.
- The players alone choose whether to drink anything, what to drink and how much. Hermar Group does not sell, supply, serve or control any beverage.
- Alcohol consumption is never risk-free. It can impair judgment, coordination and reaction time; can cause injury, illness, alcohol poisoning, addiction and death; and interacts dangerously with many medications and drugs.
- Drinking games can lead to rapid or excessive consumption. You must never use the App as a reason to drink faster, drink more, or drink more than you otherwise would.
- Any decision to consume alcohol while using the App is your sole and voluntary decision, must comply with applicable law, and is made entirely at your own risk.
If anyone in your group chooses to drink alcohol, you agree to follow these rules at a minimum:
- Never drive, cycle, ride, swim, operate machinery or do any activity requiring alertness after drinking. Arrange a designated driver, a taxi or another safe ride before you start.
- Do not drink alcohol if you are pregnant or may be pregnant, are under the legal drinking age, take medication that interacts with alcohol, have a medical condition that alcohol may worsen, or are recovering from alcohol or substance use.
- Switch to water or any non-alcoholic option at any time, for any reason, without explanation. Alternate every alcoholic drink with water and eat before and while drinking.
- Never pressure, dare, trick or encourage anyone to drink, and never give alcohol to someone who is visibly intoxicated.
- Stop the game immediately if anyone feels unwell, and look after each other.
Know the signs of alcohol poisoning
Confusion, vomiting, seizures, slow or irregular breathing, bluish or pale skin, low body temperature, or being unable to wake up are medical emergencies. Do not let the person "sleep it off". Call your local emergency number immediately (911 in the United States, Canada and Mexico; 112 in Spain and the European Union; 123 in Colombia) and stay with them. In the U.S., free and confidential help for alcohol use is available 24/7 from the SAMHSA National Helpline at 1-800-662-4357.
The App is not medical, health, nutritional or legal advice, and nothing in the App replaces the advice of a qualified professional.
4. Games, challenges and dares
The App includes games such as Charades, Impostor, Never Have I Ever, Truth or Dare, Categories and Trivia, as well as randomly selected bonuses, penalties and challenges. Some content is intended for adults and may include mature, suggestive or personal themes. Trivia answers and other informational content are provided for fun and may not be accurate or up to date.
Every challenge, dare, question and penalty is a suggestion only. You and every other player are always free to skip, change or refuse any of them, with no consequence other than the game's own scoring. You agree that you will not, and will not ask or allow anyone else to:
- do anything illegal, unsafe, or that could injure yourself or others or damage property;
- touch, kiss, undress or engage in any physical or intimate contact with anyone without their clear, enthusiastic and ongoing consent;
- harass, bully, humiliate, threaten or discriminate against anyone, or pressure anyone to share information they do not want to share;
- photograph, record, livestream or publish anyone without their consent;
- use the App in a way that disturbs neighbors, violates the rules of the venue you are in, or breaks local law.
Some games ask you to hold the phone to your forehead, tilt it or pass it around. Hold the device securely and play in a safe, open space. We are not responsible for damage to your device or to other property.
5. Assumption of risk and host responsibility
You understand that social gatherings, party games, physical challenges and, where chosen by participants, the consumption of alcohol involve inherent risks, including the risk of illness, injury, property damage, embarrassment, conflict between participants and, in extreme cases, death. You voluntarily assume all such risks, known and unknown, arising from your use of the App and from any activity you or others choose to take part in while using it.
The person who organizes the game or enables drinking-themed options (the "host") is responsible for the safety of the gathering, including verifying participants' ages, ensuring participation is voluntary, offering water and non-alcoholic drinks, and arranging safe transportation. Hermar Group is not present at your gathering and cannot supervise, monitor or control how the App is used.
6. PartyMaster Pro subscriptions and purchases
Some features are available only with a paid PartyMaster Pro subscription. Available plans (for example weekly or annual), prices and any free-trial terms are shown in the App before you buy and may vary by country.
- Payment is charged to your Apple ID (App Store) or Google account (Google Play) when you confirm the purchase.
- Subscriptions renew automatically at the end of each period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in your App Store account settings (Settings > your name > Subscriptions) or in Google Play (Payments & subscriptions > Subscriptions). Deleting the App does not cancel a subscription.
- If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription. If you do not cancel before the trial ends, the paid subscription starts automatically.
- Cancellation takes effect at the end of the current billing period; you keep access until then.
- Purchases are processed by Apple or Google, not by us. Refund requests are handled by them under their policies (for Apple: reportaproblem.apple.com), except where applicable law gives you a right to a refund from us.
- You can restore previous purchases on a new device from the App's settings using the same store account.
We may change subscription prices or features. Any price increase will be communicated in advance as required by the App Store or Google Play and applicable law, and you can cancel before it takes effect.
7. License and acceptable use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial entertainment on devices you own or control, as permitted by the usage rules of the store you obtained it from.
You agree not to: copy, modify, translate or create derivative works of the App; reverse engineer, decompile or try to extract its source code, except where law expressly permits; remove proprietary notices; rent, sell, sublicense or redistribute the App or its content; circumvent any access control or payment mechanism; use the App for any unlawful purpose; or use the App or its content in any public or commercial event, promotion or broadcast without our written permission.
8. Intellectual property
The App and all its content, including games, questions, prompts, artwork, characters, sounds, text, software, the PartyMaster name and logos, are owned by Hermar Group or its licensors and are protected by intellectual property laws. Except for the limited license above, no rights are granted to you. Player names and custom game settings you enter stay on your device and remain yours.
9. Privacy
Player names, avatars, preferences and game progress are stored locally on your device. Purchases are processed by Apple or Google, and subscription status is managed through our payment-infrastructure provider (RevenueCat), which receives an anonymous app user identifier and purchase records. Our Privacy Policy explains what information is processed and your rights. Do not enter sensitive personal information about yourself or others as player names. Read the Privacy Policy →
10. Third-party services
The App relies on third-party services such as the App Store, Google Play and RevenueCat. Your use of those services is subject to their own terms and policies, and we are not responsible for them. You are also responsible for any carrier data charges.
11. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", FOR ENTERTAINMENT PURPOSES ONLY, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF HARMFUL COMPONENTS, THAT CONTENT IS ACCURATE OR APPROPRIATE FOR ANY GROUP, OR THAT USING THE APP IS SAFE FOR ANY PARTICULAR PERSON OR ACTIVITY.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HERMAR GROUP, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS OR AGENTS BE LIABLE FOR ANY PERSONAL INJURY, ILLNESS, ALCOHOL-RELATED HARM, PROPERTY DAMAGE, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) THE CONSUMPTION OF ALCOHOL OR ANY OTHER SUBSTANCE BY YOU OR ANY OTHER PERSON; (C) ANY CHALLENGE, DARE, GAME OR ACTIVITY PERFORMED OR ATTEMPTED BY YOU OR ANY OTHER PERSON; OR (D) THE CONDUCT OF ANY PLAYER OR THIRD PARTY; WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP AND SUBSCRIPTIONS IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US$50).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, such as liability for death or personal injury caused by negligence, or for fraud or willful misconduct. In those jurisdictions, the above exclusions and limitations apply only to the extent permitted by law.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Hermar Group and its members, managers, employees, contractors and licensors from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the App; any alcohol or other substance you provide, serve or consume; any gathering you host; any challenge or activity performed by you or by people playing with you; or your violation of these Terms or of any law or third-party right.
14. Changes to the App and to these Terms
We may update, change, suspend or discontinue all or part of the App, its content or its features at any time. We may also update these Terms. When we do, we will change the "Last updated" date above and, if the change is material, give reasonable notice in the App or on this website. Changes do not apply retroactively. Continuing to use the App after changes take effect means you accept the updated Terms; if you do not agree, stop using the App and cancel any subscription.
15. Termination
You may stop using the App at any time by deleting it and cancelling any subscription. We may suspend or terminate your license if you breach these Terms. Sections that by their nature should survive termination, including the alcohol policy, assumption of risk, disclaimers, limitation of liability, indemnification and governing law, will survive.
16. Governing law and disputes
These Terms are governed by the laws of the United States and of the State in which Hermar Group LLC is organized, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at support@hermargroup.com and try to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in that State, and you and we consent to their jurisdiction, except that either party may bring an individual claim in small-claims court where eligible.
If you are a consumer living outside the United States, nothing in these Terms deprives you of the protection of mandatory provisions of the consumer protection laws of your country of residence, or of your right to bring proceedings in the courts of that country where local law grants it.
17. Additional terms for Apple App Store users
If you downloaded the App from the Apple App Store, the following also applies:
- These Terms are between you and Hermar Group only, not Apple Inc. ("Apple"). Hermar Group, not Apple, is solely responsible for the App and its content.
- Your license to use the App is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- Apple has no obligation to provide any maintenance or support services for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Hermar Group's responsibility, to the extent not disclaimed in these Terms.
- Hermar Group, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, Hermar Group, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
18. General
These Terms, together with our Privacy Policy and any terms shown at the point of purchase, are the entire agreement between you and us about the App. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms are available in English and Spanish; if there is any inconsistency, the English version prevails, except where the law of your country requires otherwise.
